What is e-Evidence?

As communication, business transactions, and data storage increasingly move online, electronic evidence has become a critical part of criminal investigations and legal proceedings.

e-Evidence refers to any electronically stored information that can be used as evidence, including emails, text messages, call logs, subscriber information, social media content, GPS data, and cloud-stored records.

Why was the EU e-Evidence Framework Introduced?

Traditionally, law enforcement authorities had to rely on complex cross-border legal assistance procedures to enquire stored data in another country. These processes were often slow and inefficient.

To address this challenge, the European Union introduced the e-Evidence Package, consisting of Regulation (EU) 2023/1543 and Directive (EU) 2023/1544, enabling authorities to request electronic evidence directly from service providers across EU Member States.

Who Is Affected?

The legislation applies to a broad range of digital service providers, including:

  • Telecommunications and email providers
  • Internet service providers
  • Cloud and hosting providers
  • Information Society Services enabling user-to-user communication such as
Social media, online marketplace, online gaming and gambling platforms
  • Domain name and IP service providers

What Does This Mean for Service Providers?

Organizations covered by the regulation must be able to receive, process, preserve, and deliver electronic evidence requests from authorities within strict legal timeframes. Providers must respond within 10 days, in urgent cases within 8 hours.

To comply, service providers need efficient processes for:

  • Managing Production and Preservation Orders
  • Collecting data from multiple systems
  • Meeting regulatory deadlines
  • Maintaining security and auditability
  • Protecting user privacy and data integrity

Key Dates

  • February 2026: EU Member States must implement the Directive into national law.
  • August 2026: The Regulation becomes fully applicable across the EU.
